Zoning Board of Appeals

PLEASE TAKE NOTICE that the Town of Clay, in response to the continuing Emergency Circumstances caused by the COVID-19 Pandemic and consistent with the NYS Governor’s Executive Orders, including but not limited to, Executive Order 202.1, shall conduct a Zoning Board Meeting on Monday, May 11, 2020 commencing at 7:30 PM, local time, to be held at the Town of Clay Town Hall at 4401 State Route 31, Clay, New York 13041 in person or by virtual appearance of the Zoning Board Members, invited Officers and Staff online via with the ability for the public to listen to the proceedings of the meeting.
The public will not be allowed to attend the meeting due to Executive Order Guidelines. Members of the public shall be allowed to listen to the meeting by accessing the WebEx website at, which can be accessed by using meeting code number 795 749 106 Meeting password: ZBAMAY11 (92262911 from phones and video systems), Host key: 933904 or accessed from a mobile phone by dialing phone number +1-408-418-9388 and enter meeting code number 795 749 106 and meeting password: 92262911 at the date and time noticed herein.
Further, the public is encouraged to offer its comments in writing to the town by email communications to the Planning & Development Department at no later than May 8, 2020 by 10:00 AM. All comments will be entered into the record and distributed to all Board Members. Fax communications will also be accepted and may be sent to (315) 622-7259. Mailed comments should be sent to: Town of Clay, Planning & Development, 4401 State Route 31, Clay, New York 13041. All meetings of the Town will be recorded and later transcribed. The transcriptions will be made available online upon review and completion at the town website.
The meeting agenda will be published on the town website and the meeting may include any additional business that comes before the Board.


The Zoning Board of Appeals (ZBA) meets on the second Monday of each month, starting at 7:30 PM. All meetings are held at the Town of Clay, Town Hall, 4401 State Route 31, Clay, NY. Agendas and legal notices are published on this website in the Post-Standard, the official newspaper of the Town of Clay. The powers of the ZBA are established by state law, which establish the ZBA as an appellate board who can review the application of a person who has applied to the Code Enforcement Officer for a building permit and such permit was denied. An "aggrieved" citizen can also appeal the decision of the Code Enforcement Officer where a permit was granted. In both instances, the ZBA is the first level of appeal from the decision of the Code Enforcement Officer. There are three types of matters that come before the ZBA. They are variances, special permits, and interpretations. There are two types of variances: area variances dealing with dimensional issues such as setbacks from property lines, and building heights; and use variances, that allow a use not otherwise permitted on the property by the Zoning Ordinance. The applicant must provide proof of their case to the ZBA to receive a variance.
