ZONING BOARD OF
APPEALS
APPROVED
MINUTES OF MEETING
January 14, 2008
The organizational and regular meeting of the Zoning Board of Appeals of the Town of Clay, County
of Onondaga, State of New York was held at the Town Hall of Clay, New York on January 14, 2008.
Chairman Fennhahn called the meeting to order at 7:30 P.M. and upon the roll being called the
following were:

ORGANIZATIONAL MEETING:
MOTION made by Chairman Fennhahn to accept the 2008 Scheduling Calendar, which states the
filing dates of when a completed application is to be received from an applicant, for a variance, special
permit or interpretation. Motion was seconded by Deputy Chairman Mangan.
Carried.
MOTION made by Chairman Fennhahn appointing Charles Mangan as Deputy Chairman. Motion
was seconded by Mrs. Liebi. Carried.
Chairman Fennhahn introduced Robert Germain as the new Zoning Board Attorney.
REGULAR MEETING:
MOTION made by Mr. Hess that the Minutes of the meeting of December 10, 2007 be accepted.
Motion was seconded by Mr. Liebi. Carried.
OLD BUSINESS:
Case #1283 - Tammy Feldman, 120 Northfield Drive (Tax map #102-04-07.0):
The applicant is seeking a variance to reduce the allowed front yard setback from 25 feet to 12 feet for
the purpose of constructing a proposed front yard addition to the existing residence.
Chairman Fennhan adjourned this case at the December 10, 2007 meeting, as the applicant was not
prepared to give the standards of proof.
Ms. Feldman addressed the Standards of Proof:
1. She feels it won’t detract from the character of the neighborhood.
2. There is no other feasible place, the space is not very big.
3. She does not feel the variance request is substantial.
4. No, there will be no adverse environmental impact.
5. The need for the variance is self-created.
Chairman Fennhahn asked Mr. Balcer if he had any comment and he said that the Planning
Department has no problem, but he pointed out the applicant has had four previous permits,
some of which have not been completed. If this request is granted the applicant should make
sure the contractor follows through with the inspections so that the applicant receives their
certificate of compliance from the code enforcement officer. Ms. Feldman would also need a
building permit in the future if she plans to enclose it. An updated survey will be needed for
any new permits, so all previous permitted work is shown.
Mrs. Liebi asked about the shed that was shown on her drawing and Ms. Feldman said it had
been removed.
Chairman Fennhahn asked if there were any further comments or questions and there were
none. Chairman Fennhahn asked for those in favor and those opposed to granting the variance
and there were none.
Chairman Fennhahn closed the hearing.
MOTION was made by Mrs. Liebi in Case #1283 that the variance be granted with the
condition that it be built in substantial compliance with Exhibit “A” and “B”, dated September
18, 2007. Motion was seconded by Mr. Hess.

The variance is granted.
There being no further business, Chairman Fennhahn adjourned the meeting at 7:40 P.M.
