                  ZONING BOARD OF APPEALS

                 MINUTES OF MEETING                       

                    
             January 9, 2006

The regular meeting of the Zoning Board of Appeals of the Town of Clay, County of Onondaga, State of New York was held at the Town Hall of Clay, New York on 
January 9, 2006.

Chairman Fennhahn called the meeting to order at 7:30 P.M. and upon the roll being called the following were:

                     Vivian I. Mason           Secretary
                     Mark Grobosky           Attorney
                     Cindy Heid                   Assistant Commissioner of Planning and Development

ABSENT:    Karen Liebi                  Member
                     Harold Henty               Member

MOTION made by Mr. Mangan that the Minutes, including the detailed resolution for Case #1215 for Dunkin Donuts, which was adopted unanimously by the board on December 12, 2005 be accepted. 
Motion was seconded by Mr. Young. Carried.

MOTION made by Chairman Fennhahn approving the submittal dates and the meeting schedule dates for the Zoning Board of Appeals for the year 2006. Motion was seconded by Mr. Mangan. Carried.

OLD BUSINESS:

Case #1217 - VARIANCE - Mufale Builders, Inc., 5229± Caughdenoy Road (tax map #075-02-06.2: 

The applicant is requesting a variance to reduce the arterial highway setback from 115 feet to 75 feet for the proposed lot 1000; from 115 feet to 85 feet for proposed lot 1001; from 115 feet to 95 feet for proposed lot 1002; and reducing the minimum lot frontage from 105 feet to 82 feet for proposed lot 1001; from 105 feet to 92 feet for proposed lot 1002, for the purpose of a subdivision for single family houses.

Chairman Fennhahn announced that the applicant has requested an adjournment.

Chairman Fennhahn adjourned Case #1217 to February 13, 2006.

Case #1220 - VARIANCE - Metropolitan Signs, Inc., 3451 Route 31 (Tax map #019-02-33.1):

The applicant is seeking a variance changing the following: 
1} Reducing the front setback from 25 feet to 2 feet; 
2} Increasing the square footage from 32 to 116.64; 
3} Allowing the use of blinking, intermittent, flashing, or other animated forms of illumination as prohibited in 230.4C(B) 5C; and 
4} To increase the height from 10 feet to 23 feet 2 inches, (from a monument sign to a free standing sign) for the purpose of installing a free standing sign.

Chairman Fennhahn announced that the applicant has withdrawn their request for the variances.

There being no further business, Chairman Fennhahn adjourned the meeting at 7:41 P.M.
