The regular meeting of the Planning Board of the Town of Clay, County of Onondaga was held at Town Hall located at 4401 State Route 31, Clay, New York on the 9th day of December, 2009. The meeting was called to order by Chairman Lepkowski at 7:30 PM and upon roll being called, the following were:

Chairman Lepkowski announced that Deputy Chairman, John Dougherty handed in his letter of resignation effective December 31, 2009. Chairman Lepkowski thanked him for his years of service and wished him luck.

A motion was made by Allen Kovac seconded by Russ Mitchell to approve the Minutes of Previous Meeting.

Public Hearings:

2009-11-3 Woodside Developers, Inc. /Norwood Holdings, LLC (3), Preliminary Plat - on W. Taft Road (Inverness Gardens f/k/a Woodside Runne)

Chairman Lepkowski opened the Public Hearing. Hal Romans, of Ianuzi and Romans, presented the plan. This is a 41.2 acre parcel, located on the south side of Taft Road. The Onondaga County D.O.T. will allow full access at the Wegmans light; and a right in/ right out drive from the retail portion of the parcel.

There will be no access to the existing residential from the new proposal . The Highway Superintendent will assist in choosing a suitable gate for emergency access to Opal Drive. All snow removal at the gate will be paid for by the Home Owners Association.

Hal Romans showed the two large storm water drainage systems on the plan. O'Brien & Gere is completing the drainage report, and sending it to the County.

Chairman Lepkowski commented that they should put all stop signs on the plan; he also said that the applicant had addressed all of the Counties issues and concerns.
The residential portion will be done before the commercial. The applicant is working with two builders.

Russ Mitchell asked if the proposed right of way connects to the Miller & Germain property, and the applicant stated that it is an access road that goes through because the DEC checks on that property from time to time.

Hal Romans said they will adhere to the PDD guide as previously set forth. The Chairman commented on the mail boxes being shown on the plan. The Engineer will look at the drainage.

A motion was made by Allen Kovac seconded by James Sharpe to adjourn this public hearing to January 13, 2010.

2009-11-6 Marc Safran (Clay Eye Care) (3), Site Plan - 8340 Oswego Road

Chairman Lepkowski opened the Public Hearing.

Eugenia Briava, of QPK Design Architects, explained the plan, they are here for a Site Plan. They will use the existing building; they will renovate the interior and use metal and wood veneer to create a new fascia. The material is called Predemia, it is metal with a wood veneer; it has a UV coating it is a commercial grade product that is very low maintenance.

Chairman Lepkowski asked about parking, there are 21 spaces, and according to the code the minimum spaces required are 14.

John Dougherty and Hal Henty complemented them on the building design.

Hal Henty asked Dr. Safran if he would be performing surgery at this location. The Doctor said not at this location.

The applicant is proposing a three phase plan, The Board has concerns about the length of time all three phases will take. The applicant will have to present new plans for each phase when they are ready to build.

Scott Chatfield said the applicant will have to submit a site plan, the drawings that were submitted were not a site plan.

John Dougherty asked if there are any specifications on parking in a PDD.
Chairman Lepkowski asked Mark Territo if this use conforms to the PDD that had been approved. Mark said it has.

Allen Kovac and Chairman Lepkowski commented they both like the design of the building.

Chairman Lepkowski asked if the new fascia was really a sign; pointing out the round display window. John Dougherty asked if the eye on the fascia was the Clay Eye Care's logo, then would it be considered a sign.

Chairman Lepkowski stated that he will leave the public hearing opened; the applicant must submit a proper Site Plan that includes; dumpster enclosure, landscaping as well as a sign permit.

A motion was made by Hal Henty seconded by John Dougherty to adjourn the public hearing to January 13, 2010.

2009-11-7 Walrus Enterprises, LLC (3), Preliminary Plat - corner of
Route 31 & Henry Clay Blvd.

Chairman Lepkowski opened the public hearing.
Hal Romans, of Ianuzi & Romans, explained the plan. Lot # 2 zoned RC-1, consisting of 12.15 acres. This lot is for the bank, they want to be on their own lot for financing purposes. Lot #1 Nice-N-Easy encompasses lot # 2. The County had 3 comments.

1. Storm water build out
2. Sanitary sewer
3. Vegetative buffer

Scott Chatfield stated that the engineer had concerns about the sanitary sewers.
Hal Henty said there is no way to use a septic system, due to lot size as per the County Health Department.
Scott Chatfield said there are two ways that they could handle this problem, make the lot large enough to accommodate the septic or add a condition that lot 2 as configured can not be used unless public sewer becomes available.

A motion was made by Russ Mitchell Seconded by Hal Henty to adjourn this public hearing to
January 13, 2010.

Old Business: Adjourned Hearings

*2009-10-4 KRSM LLC, Special Permit Advisory Referral 4560 Buckley Road
(Adjourned from 1 previous meeting)

Chairman Lepkowski opened the public hearing. Ms. Abar, of KRSM LLC., E-mailed the traffic study to Mark Territo, Jim Stelter with Onondaga County D.O.T. said it has no detrimental impact.

Chairman Lepkowski asked the Board if they were satisfied with the case, the Chairman closed the public hearing.

A motion was made by Russ Mitchell, seconded by Allen Kovac to make a favorable Special Permit Recommendation, for Case # 2009-10-4 KRSM LLC. Located at 4560 Buckley Road, using form # 60, stating they saw no issues or concerns.

Motion Passed 6-0

2009-12-4 Waterhouse Landing, Final Plat, Morgan Road tax map # 70-01-08.1

A motion was made by Hal Henty seconded by Allen Kovac to add this public hearing to the agenda.

Motion Passed 6-0

Chairman Lepkowski opened the public hearing; Scott Chatfield noted the Board must make a recommendation to the Town Board for approval of stop signs.The Board recommended stop signs at the following locations: Norcross Dr., where it intersects with Millstream Dr., and at Millstream Dr., where it intersects with Millstream Dr. The Board also stated lot numbers 1, 15, 16 and 45 shall have no access on to Millstream Dr. collector road, therefore the numbers 4424, 4428, 4431 and 4434 have to be removed from the map.

Chairman Lepkowski closed the public hearing.

A motion was made by John Dougherty seconded by Hal Henty to approve the Final Plat using form # 40 for Case # 2009-12-4 Waterhouse Landing tax map # 70-01-08.1 based on a map by Seguin Land Surveying , dated 09-15- 2009, final date 12-5-2009, Subject to all engineering and legal requirements.
Recommendation to the Town Board for approval and installation of stop signs at the above locations.

A motion was made by John Dougherty, seconded by Russ Mitchell to approve the sign as presented.

A motion was made by James Sharpe, seconded by Russ Mitchell to approve the sign as presented.

A motion was made by Allen Kovac, seconded by James Sharpe to approve the sign as presented.
