The regular meeting of the Planning Board of the Town of Clay, County of Onondaga was held at Town Hall located at 4401 State Route 31, Clay, New York on the 18th day of November, 2009. The meeting was called to order by Chairman Lepkowski at 7:30 PM and upon roll being called, the following were:

A motion was made by Hal Henty seconded by Russ Mitchell to approve the Minutes of the Previous Meeting.

Public Hearings:
2009-10-3 Willow Stream Apts. N II LLC (3) Amended Site Plan -
3774 State Route 31
Chairman Lepkowski opened the public hearing.
Brian Bouchard, of Clough Harbor Associates, explained the revised plan. The applicant moved the parking lot, and added three dumpster enclosures. The dumpster enclosures will be consistent with the current building materials. Chairman Lepkowski asked if the description of the lot lines
are in writing.
Chairman Lepkowski closed the public hearing.
A motion was made by Russ Mitchell seconded by John Dougherty to adopt a resolution using standard form # 10, SEQR determination for Case # 2009-10-3 Willow Stream Apartments N. II LLC., located at 3774 State Route 31 be declared a negative declaration as it appears to have no environmental impact which can not be mitigated and does not involve any other permit granting agencies, including the Federal Government.

A motion was made by John Dougherty seconded by Hal Henty to adopt a resolution using standard form # 20, Site Plan approval for Case # 2009-10-3 Willow Stream Apartments N. II LLC., located at 3774 State Route 31, based on a map by CHA , drawing # 18147, dated 2-4-09

2009-10-4 KRSM LLC, Special Permit Advisory Referral –
4560 Buckley Road
Chairman Lepkowski opened the public hearing. Jan Abar, of KRSM LLC gave an overview of the plan. Ms. Abar explained this property is zoned I-1; the applicant would like a change of use to trucking terminal. This is a courier service, they have 10 fulltime employees. They are opened 24 hrs. a day. The applicant leases the building, they do not own any trucks, and all the trucks coming and going are sub-contractors.
Hal Henty asked what kind of traffic is generated. The County DOT stated that during peak hours there are 10 trucks per hour.
Chairman Lepkowski stated the fire marshal wants the parking spaces and signage shown on the plan.
John Dougherty asked how much of the 32,000 sq. ft. are they using. Ms. Abar said they use all of the building. There is no storage on site, the tractor-trailers come in get unloaded, the delivery trucks get loaded and leave.
Chairman Lepkowski asked the applicant to scan the traffic study and e-mail it to Mark Territo, Commissioner of Planning, so he can get it to the Board Members for their review.
John Dougherty said he doesn’t see lighting on the plan, he would also like to see the parking spaces and signage on the plan.
A motion was made by John Dougherty seconded by Hal Henty to adjourn the public hearing to December 9, 2009.

2009-10-1 Upstate New York District Church of the Nazarene (3), Amended Site Plan – 5367 NYS Route 31 (Adjourned from 1 previous meeting)
Chairman Lepkowski, opened the public hearing. Teresa Lutoborski of Group One Design presented the revised Site Plan. Ms. Lutoborski explained the applicant decided to consolidate the entrances, having only one; she added the silt fence on the plan. The Chairman noted that the leach field was in the correct place on the plan.
The elevator wording was corrected on the architectural drawings.
A Fireman from Clay VFD asked how wide the drive would be Ms. Lutoborski said it would be 24 ft. wide. The Fireman wanted to make sure multiple trucks could get in to fight a potential fire.
Chairman Lepkowski closed the public hearing.

A motion was made by Russ Mitchell seconded by John Dougherty to adopt a resolution using standard form # 20 granting Site Plan approval for Case # 2009-10-1 Upstate New York District Church of the Nazarene located at 5367 NYS Route 31, based on a map by Landscape and Prospect drawing #L-100, dated September 28, 2009, revised November 16, 2009.

2009-11-4 Lawton Valley Hunt section # 16 Final Plat
A motion was made by Allen Kovac seconded by Hal Henty to add this public Hearing to the agenda. There are no changes since the Preliminary Plat.

Chairman Lepkowski opened the public hearing.
Art Humbold, of Ianuzi and Romans, explained the Final Plat. The State DOT comments have all been addressed. The applicant is waiting for 3 grading approvals; and waiting for National Grid to move two (2) utility poles.

A motion was made by John Dougherty seconded by Allen Kovac to adopt a resolution approving the Final Plat for Case # 2009-11-4 Lawton Valley Hunt section # 16 located off NYS RTE 31, using form # 40 , based on a map by Ianuzi and Romans LLC. Drawing # 1774.004 dated June 2, 2009.
