The regular meeting of the Planning Board of the Town of Clay, County of Onondaga was held at the Town Hall, located at 4401 Route 31, Clay, New York on the 8th of March 2006. Chairman Walter Lepkowski called the meeting to order at 7:30 PM and upon the roll being called, the following were:

Approval of Minutes:

Motion was made by Bruce Johnson, seconded by Karen Guinup, to approve the minutes of February 8, 2006 as presented.

Public Hearings:

Old Business: Adjourned Hearings

05-9-1 Georgian Court Enterprises, LLC (3) Site Plan for Apartments, west of Morgan Road, off Grampian Road, between West Minster Place and Hollyrood Park (Adjourned from 7 previous meetings).

The applicant sent a fax requesting adjournment to the first meeting in April.

Motion made by Karen Guinup and seconded by Casey Jordan to adjourn the meeting to April 12, 2006.

05-12-1 Subdivision Inc., Zone Change Recommendation RA-100 to R-10 on the east side of Morgan Road, opposite Fairway East Drive (Adjourned from 3 previous meetings)

The applicant requested adjournment to the first meeting in May.

Motion made by Casey Jordan and seconded by Karen Guinup to adjourn the meeting to May 10, 2006.

05-12-3 Heather Associates, Inc. (3) Riverwalk Preliminary Plat on the north side of Guy Young Road, west of the Clay Town line (formerly On the Canal) (180 lots) (adjourned from 3 previous meetings).
Presenter: Hal Romans, Surveyor, and Michael Bragman

Mr. Romans presented the revised preliminary plan for Riverwalk subdivision formerly On the Canal. The plans having been change to avoid the wetlands. The plan consists of 178 residential lots and lot 179 being given to Save the County. The Town Board approved the deviations from the drainage standards on sixteen lots. Mr. Romans indicated they had received some comments from the Town Engineer with regards to the preliminary grading plans. Currently on the map there is a storm sewer line west of the Town of Clay line. The location noted as P1 is an historical to be avoided. The only additional impact would be the grading for the storm management area. The applicant met with the Army Corp of Engineers and the DEC, they are both receptive to the plan and like it. 

The Chairman opened the hearing to the public.

Mr. Steve Fleury, a resident of the area for 19 years, had a concern about a buffer between his property and twelve of the lots it backs up to. He also wanted to be sure his property was still zoned for agricultural, because of his animals. 

Mr. Bragman indicated that when this was first proposed that there were 269 lots involved. It has now been significant decreased down to 179 lots. Looking at the map Mr. Fleury’s land is significant higher than the other property. For the most part the purposed homes will be constructed at a lower level below eye site when standing in the Fleury’s back yard.

Chairman Lepkowski closed the public hearing and asked for a SEQR declaration.

In the case 05-12-3 Heather Associates, Inc. (3) Riverwalk Preliminary Plat on the north side of Guy Young Road, west of the Clay Town line. 

Whereas, the Clay Planning Board has received an application for an amended preliminary plat from Heather Associates, Inc. for the property formerly known as “On The Canal” and now know as Riverwalk; and

Whereas, said subdivision involved a Zone Change from the Town Board as well as subdivision and other approvals; and

Whereas, the project is a Type I action for purposes of SEQRA and the Town Board has been designated as lead agency; and

Whereas, the Town Board has reviewed the environmental submittal and has issued a negative declaration; and

Whereas, the applicant’s environmental submittals, including an EAF, supporting data and modified proposed findings has been submitted and reviewed by the Planning Board; and

Whereas, the Planning Board, as an involved agency must make its own findings regarding the subdivision application in accordance with 6N.Y.C.R.R. pt 617 et seq.

Whereas, the Planning Board accepted the Statement of Findings dated December 10, 2003 and now desire to make amendments to the previously approved preliminary plat. 

Now Therefore, after due deliberation and consideration the Planning Board of the Town of Clay makes the following findings by adopting the Revised Statement of Findings dated January 24, 2006. 

Negative SEQRA made by Bruce Johnson and seconded by Karen Guinup.

Motion passed 4-0.

Motion made by Karen Guinup, seconded by Casey Jordan for planning case number 05-12-3 granting preliminary plat approval for the adoption of resolution using standard form #30 based on a map by Ianuzzi & Romans dated October 19, 2005, last revision date March 8th file number FB 1431.014 subject to legal and engineering requirements.

05-11-1 Angelo Chiodo (3) Preliminary Plat, southeast corner of Bear and Allen Road (8 lots) (From 3 previous meetings).
Dave Hannig, surveyor, presented.

Mr. Hannig presented the relocation of the driveway to opposite Manor Drive. Jim Stelter with the County will be faxing over a letter of approval. The three driveways make a better intersection with Manor Drive. Additionally, all our driveways on Allen Drive will be opposite existing driveways. In previous meetings, the Planning Board brought up the issue of the driveway onto Bear Road, however, the County indicated this is not a concern.

An environmental report was completed and it will be passed through during the final process to allow us to get the access to the sanitary sewer. The engineering is complete in its preliminary form and the engineers are ready to do their final plan. 

05-11-1 Motion made by Bruce Johnson, seconded by Karen Guinup, to adopt a resolution using standard form #10 that the preliminary site plan proposed by Angelo Chiodo be declared a negative declaration for not having an adverse environmental impact reason supporting this determination is that there are no impacts on either traffic, drainage, or the environment which can not be adequately mitigated. 

Motion passed 4-0.

05-11-1 Motion made by Karen Guinup, seconded by Bruce Johnson to adopt a resolution using standard form #30 granting the Preliminary Plat approval for Angelo Chiodo be approved based on the map by D.W. Hannig of June 25, 2005, revision date is February 23, 2006 based on the file #J058968 subject to the following conditions:
1. Subject to approval of reciprocal easement agreement for lots 3, 4, 
and 7.
2. Subject to all legal and engineering requirements 

Motion passed 4-0.
